Cross lease insurance and ccc

#Post
1

Does anyone have any information regarding building works on a cross lease that has not been signed off and does not have a ccc. Auckland Council say they will just keep rolling over the BC for however long it goes on for .
Does this affect insurance on the other flats.

Do other flats share party walls or are they separate?

All have party walls
3/5 flats are two storied

The remaining two are one on top of each other

Why cannot the insurer answer this question?

It’s not our flat requiring the ccc and there are three different insurers in the block. We don’t know why the cc was declined and council are not forthcoming

But why cannot your insurer tell you how the issue affects your insurance?

Is the work in the flat plans? If that's the case then all the owners have accepted the work and the risk that it comes with.
For insurance they normally have an automatic exclusion for unconsented work you can still buy insurance but just remember that any claim arising out of unconsented work will be declined.

Thanks mone.
That’s what I was after. The works are not unconsented. Just unfinished and the CC denied.
The works started without the consent of any of the owners. Neither did the rebuild have liability insurance so we were wondering what our liability was as a near neighbour moving forward. We had a number of claims due to damage to our below flat from the building works and that is now settled. Insurance company described the situation as most unusual.
Our tenants have given notice because of the airborne noise above. It’s as if you are in the same room plus some so why does this happen when there is soundproofing required on the BC and that works has been sign off and accepted.
We don’t know why they failed their CC and council wont give us that information. Work was carried out on our property without our consent so we have asked for a split in the BC so we can finish any works on our flat but we got a no response.
Also the BC states no work to lower flat (us) then the drawing in the same diagram show works to the lower flat.

You were after guesswork? Would not your insurer be best placed to advise how your policy applies in this scenario rather than a message board?

I must be thick today (perhaps it's the hayfever) but I cannot see how a bunch of strangers on a message board with no first hand knowledge is better placed to advise on an insurance policy than the insurer and the insured.

You want fries with that?
