Can you rent out an over 60's unit

Can you rent out an over 60's unit, if the new tenant is over 60 . A friend is wanting to move to a country area popular holiday town Thermal resort Hanmer Springs.. Doesn't want to sell. Has private Chalet on Hanmer site.

Any ideas?

There seems nothing in the agreement about this, forgot to mention, Body corporate isn't enforced either. Block of 4 units

Sale and Purchase Agreement from lawyer should have details. If not ask the lawyer.

There was a time when some high density developments required residents to be over 60 (or some other age).

But age description is generally not legal now so in some/many/all cases that requirement is unenforceable.

Some body corporates had an an age requirement for residences, but then the owners realised that the units were worth more or could get more rent if it was removed.

Do your research, talk to your lawyer. These is no universal rule.

I have a different friend with a property also a block of 4 2 story town houses built late 80's He seems to have the only lease document in possession . It says on the document , owner occupier only, words to the effect. If rented "ALL" owners must approve. yet 2 are rented out, he was never consulted. Could this be enforced ? PS he has no problem with the neighbours, but if that changed

Yes it can (probably) be enforced, if there has not been an agreed change. However enforcement will be messy, expensive, and screw up lots of relationships.

If anyone is unfortunately an owner of a unit property title it is critical that they attend all meetings, make sure rules are complied with and that they understand what is going on.

My somewhat informed view of body corporates is that many are run by a minority of self absorbed pricks and sometimes a compliant property manager whose only interest is to hold onto money until they sell or die without consideration of others.

The Unit Titles Act is a nice read, but mostly ignored.
