90 day notice

1 | Was visiting friends yesterday, and they said they had been served a 90 day notice to vacate their rental. This came as a shock but understand it happens. However, the letter is from a trustee that says they are selling house etc. Friends have been in house for 8 years, and have tenancy agreement with owner, and when they tried to contact owner, everything gone unanswered. The letter they received from trustee outfit was hand delivered but contains no name, no phone number or email, just states that in this environment its best to sell the house so heres yr 90 days. Is this standard practice not to be informed if a rental changes hands etc and this happens. They are in limbo as have no idea what's going on. kletis1 - 2021-05-01 12:24:00 |

5 | What was it about the notice that says it was from the trustee if there was no name etc? Certainly sounds suspect. pico42 - 2021-05-01 16:34:00 |
6 | Have they thought perhaps the owner has died and the trustee company is winding up the estate. It does somewhat odd that no other communication has been received and with no contact numbers or names on the notification it is certainly suspect. Would certainly approach tenancy people to see if they have any info. Capricorngirl mlarkin - 2021-05-01 16:44:00 |
7 | The bond details will have to have been changed and you will have been notified. If you haven't then ignore it. trike.tours - 2021-05-01 16:47:00 |
8 | Ignore it as a scam. Someone wants you to move out so they can move in. Of course I spoke with the tenant, and he was going to "talk" with his "mate" smallwoods - 2021-05-02 09:25:00 |

10 | To whom do you pay the rent? kenw1 - 2021-05-02 15:43:00 |

12 | How about the tenants apply to the Tenancy Tribunal for a decision as to whether the notice is or is not legit. Would take a little effort to apply, prob including the tenancy agreement, bank payment made to, Bond Centre stating whether or not there has been a change of landlord, efforts made to contact the landlord. If nothing else it should buy the tenants more time. artemis - 2021-05-02 16:48:00 |

But what if the TT holds the notice to be valid, that would have used up a lot of their 90 days. kenw1 - 2021-05-02 20:18:00 |

And what's it going to be like if OP ignores it and just sits there waiting for the landlord to call asking to arrange the final inspection? Sometimes its better to front up to these things - they won't just go away.... sparkychap - 2021-05-02 20:48:00 |
15 | I said maybe owner is sick or something as he hasnt returned calls. They still pay rent into his account as always. This letter has no info on it other than they gave to leave as the trustees are selling house due to being a good market lol. kletis1 - 2021-05-03 14:59:00 |
