My kid has talked to apple to reset her phone after locking it, as long as you know the answers to your 3 security questions and a few other things you should be fine.

It's the double edged sword of the most secure smartphones.

Get this a lot at the shop, just never know if it's true or stolen

is there a fix? Ridiculous state of affairs to lock a phone that I have paid for but now cannot use. Security or not this security system is flawed there should be some other form of security surely

It's not flawed at all. It's designed to keep your data safe if you lose or have the phone stolen. Do you not have access to your Apple ID associated with the old phone? Surely it's the same as your new phone.

No, the problem is this old phone was used to use "find my phone on icloud" and I do not remember the password I used at the time

The password is your apple id password.

not remembering a password is not a technical fault.
If the place you got the phone from still exists, they can probably reproduce the invoice (they are required to keep records for tax purposes for 7 years).
If you don't like apples security, don't buy their products. Android phones are just as feature rich, and the security is optional.

Lastly, do not use a 3rd party service, they are all scams. If you can't get it solved with apple you'll have to right it off as a loss.

Welcome to the Apple Brick Company.. "just one slip of the memory and you have the most expensive paper weight in the world".

"if the place you got the phone from still exists, they can probably reproduce the invoice (they are required to keep records for tax purposes for 7 years)." It is one thing to produce a receipt from ABC Phone Ltd that shows they sold a iPhone 5 on 27th Feb 2019, it is sometimes another thing for the receipt to also say it was serial number 12345 and it was sold to Fred Smith..
The bloke I share an office with is just going through this exercise as we speak... he is on to week 2 of the process... it appears that every document they require must be scanned and emailed to them several time, because for a very tech savy company their email system seems to have endless black holes that stuff just disappears into !! Once they finally have all the documents / information then there is a complex, time consuming approval process before any actual progress happens... you'll be humming in your sleep all the "music on hold" tune you will be subjected to !!!

If you forget your password you can reset it with your email or other Apple devices. Don't let that get in the way of your story though.

Can you please basically outline the procedure... please factor in that the user does not have any email address associated with the apple device and it has never been backed up to the cloud or similar
