I am wondering if there is anyone here who has had the misfortune to have had to make contact with the Determinations department of MBIE. Making an application involves several steps 1. Deciding yourself if you qualify. 2. They assess the application. 3. They accept the application. I have made it to step 2 and the only thing they have provided is two dummies and a suggestion that you may want to abandon your application take a refund and try somewhere else. The reason for the suggestion is one of the Determination Advisors is by their own admission incompetent and incapable of making a decision so passed the application on to someone more qualified. The more qualified individual appears to be as stupid as the first advisor and I have had to make a complaint. I'm wondering if you (anyone) has had to abandon an application for a similar reason(s).

Some but my problem is more about the performance of the people assigned to assess the determination application.

Interesting point. That's changed my thinking straight away I wonder if that is their MO, perform abysmally in the meantime hoping the applicant will simply pack up and more on. It's seriously frustrating that the first person you come into contact with declares themselves incapable only to find the next is as equally incompetent.

You could use the Official Information Act - that should get their attention though the actual reply might take a while. Give brief background. Ask for the qualifications and experience of the named people. Perhaps also ask for the MBIE procedure and confirmation that is has been correctly followed. You are permitted to ask for all their internal emails and notes wrt your case.

Also a general point, before making a complaint it is a good idea to request your issue is escalated. Use that word specifically. They have to send the issue upstairs and an OIA request can ask if it was done and the response.

Good info at fyi.org.nz though as it is a public site it is not appropriate to include personal info and send it from there. You can check other requests from the site relevant to your issue, if any.

The OIA is very powerful - more people dicked around by government and councils should use it.

OIA seems to be ignored more and more by certain government departments. The enforcement is toothless.

Not my experience luckily, but there is recourse to the Ombudsman. That gets senior management attention. I guess my point is that there is no downside to making an OIA request - takes a bit of thought to formulate it and include as many relevant queries as possible, but otherwise very little time to write. Certainly less time than the receiving organisation.

Certainly won't work if no OI request made. The site fyi.org.nz has thousands of searchable and rated responses.
