What is it called when a mortgage is cleared?

Too many variables to consider even in that scenario - there is no average. How long is a piece of string? Absolute minimum of 6 months from grant of probate assuming probate is needed but sometimes it can take a while to get probate depending on how complicit the executors are.

Complicit? Are you sure that's the right word? I thought complicit meant helping to commit a crime?

you’re right LG!

Complicit: helping to commit a crime or do wrong in some way. EG “He was complicit in the cover-up”

I just did thanks……

Interesting

‘The Executor of the Estate is personally liable for any claims made on the Estate within that six month period, so if beneficiaries want to receive their funds earlier, they can agree to sign an indemnity so that if any claims are made they indemnify the Executor for those.”

Ah... was confused. Yes, but it also depends on the beneficiaries. I was executor and wanted to finalise everything ASAP, but if a beneficiary has "issues" they can draw out the process and cost more in the long run.

A beneficiary continually emailing the lawyer, and asking for specific things from the estate, accusing me (executor) of dodgy dealings - it draws things out, and costs more money in lawyer's fees, because of the communications and time spent.

6 months from grant of probate not date of death

Odd - that sort of thing really shouldn’t make a huge amount of difference in the long run though

It didn't really, but did cost a few hundred more. I didn't care about that - I didn't think of it as 'my' money, it was my Mum's. But even in the bill, the Lawyer mentioned the extended time and communications from a beneficiary. Just saying - it's not always the executor that draws things out, it can be a malicious beneficiary.... so I wouldn't take everything the OP says as gospel either.

ah yes the old time is money…..

How much do they charge an hour now? $400? $500?

A friend of a friend got charged an astronomical amount for divorce proceedings…..they asked for a complete breakdown of times/dates spent on the case…..bill suddenly halved…..when it came time for payment, they got the amount in $1 coins and dumped it in the reception area of the lawyers office! ????

Yes, people can be horrible. You can probably guess the 'beneficiary' was my sociopath sister. Haven't heard from her for over a year so that's good, but it's taken it's toll.

$400 is standard for a partner but estates are generally charged in a scale fee basis rather than hourly rate

$330 + GST hourly rate was the latest figure we were given to wind up a family trust (about two weeks ago).

good you haven’t heard from her. Don’t waste time thinking about it now it’s behind you. Her loss. It gets easier with time.

I have several ‘wider family’ who I haven’t spoken to for several years now, both could be potential problems in the event of any estates etc, but let’s just say they are under NO illusions about me anymore. I know they thought I was a pushover but I/we won’t take any s**t from them (as they now realise lol). Luckily for us our lawyer is a personal friend and LOVES a good challenge with those ‘sorts’ of people……nothing like scaring them into just being fricken decent, fair and compliant. (ie do the right thing or it will cost them more) I firmly believe the truth and what is right always comes out in the end.

I think the “pun” was lost - sweet face like a chewed up toffee - he was funny and clever but I doubt he’d get away with half that stuff now

Far out..... is this for real?

Google, google google can add to the sum of your knowledge. If you do this every time you don't understand something or a reference it will help your general knowledge. Just like language teachers say look up a word in a foreign language that you don't remember even if you've looked it up several times before. .

I don't know. On a scale of 2, I'd give it one.
