Plenty of speculation in this post, mrcat1 has a point, and also christen seems to think you can't build three stories for some reason, anyway as you said above, stay calm and find out your rights or wrongs, things happen, everyone loves to comment and don't know the facts, just like me, these new council zones in Auckland are going to wake up a few people. Some will be upset. Life is short, have fun.

I have unfortunately been able to do that so far due to work commitments and prepaid course and exam etc which I was committed to. I am going to discuss properly with neighbour this weekend snd work out a plan. Most likely Involving lawyers / council etc.

I have a day off work next week already so will put that to good use at the time. I couldn’t get more time off this week,

Get someone to gather the information NOW, whether by paying your solicitor or someone else, so you have it before the weekend. If you don't do this then the talk with the neighbour will just involve planning to get stuff that could have been obtained earlier in the week.

There was an offer earlier in the thread to get some of this info for you......perhaps if you do not want to give your address you could give the address of the property in front of you where the development is taking place, or even the rates ref of that property which is obtainable off the council's site. Or by putting up a 50c auction with your address....something to get a hurry on.

I must be missing something .. they either have legal access or they don't ? .. hardly a mystery ..

And that is the issue. Unless it one of rare occasions where it can be disputed it really shouldn't be a problem.

Me too. As above, in 99.99% of cases it will be a simple yes or no.

It was my neighbour who found out, I’ve had other stuff going on which not going to go into here but she said there was no reason given just that it was there on council records, it’s from way back didn’t list why they got it,

So presumably everyone in the apartment block will be using the driveway as their normal access after build is complete.

All sounds very fishy to me. I'd certainly be investigating what sort of access this is and trying to understand the provenance. Also what are they doing next door? Are there building consents lodged?

Not necessarily. There’s a limit of how many cars can use a dingle driveway and he has said there will be a driveway and parking area on his section which will more than cope with it. Same as current house thrrr has its own driveway snd don’t use ours,

Might sound fishy but it is what it is. We are going to look into changing it if we can as no reason to have part of our driveway but not sure how to find out the provenance considering it was done 60 years ago and no5ing o the records,

Three storey units, details coming this week, No consents lodged as of yet was doing site testing last week, It’s a terrible site, it was sold two years prior to what we think was a developer snd he sold it again, realestate agent said a lot weren’t interested as it has a massive dip in it and not flat but who knows. Walking on it felt like it was landfill.

Didn’t sell for a huge amount so imagine it wasn’t frantic interest in it, a section 941 Sqm in central Auckland with a rented house and development potential gets more than $850k

For clarity - is this all notified on the Certificate of Titles for theirs and your land?

There should be historical paper originals at the council of all documents pertaining to your parcel of land.

why don’t you be kind and just tell her, save her the hassle, instead of all the ‘secret squirrel’ stuff between you and sparky?

Exactly why I haven’t replied. I may not know everything about council plans etc but I’m not the idiot they’re making me out to be.

yes sorry to read about all your troubles. If other posters are so clever and knowledgeable you would think they would want to help wouldn’t you? They ask all the questions and then when they claim to know the answer come up short of any helpful information.
